Whereas the present Government of this Colony by Congress and Committees, was instituted while the former Government under the Crown of Great-Britain existed. … [New York: Printed by John Holt, 1776] Broadside (302 x 245 mm). Docketed on verso "Candidates to be Chosen ye 18th Day of this Instant Return to be made ye 21st at 11 Clock Election the—25th Return Thursday—27 at 11 Clock in ye forenoon at which Time the County Committee Meet"; very lightly soiled, a few tiny, scattered spots, separation at central horizontal crease. Tipped to a mat. Half red morocco folding-case gilt, chemise. The end of colonial rule in New York and the genesis of an independent state government. Issued over the name of Robert Benson Secretary of the Provincial Council, the present broadside prints three resolutions concerning the determination of a new government for the state following a quotation of the 10 May resolution by the Continental Congress recommending that each of the United Colonies adopt "such Government as shall, in the Opinion of the Representatives of the People, best conduce to the Happiness and Safety of their Constituents in particular, and America in general." This extract from the minutes of the Provincial Council declares "Whereas the present Government of this Colony … was established for the sole Purpose of opposing the Usurpation of the British Parliament, and was intended to expire on a Reconciliation with Great-Britain, which was then apprehended would soon take place, but is now considered as remote and uncertain … And whereas Doubts have arisen whether this Congress are invested with sufficient Power and Authority to deliberate and determine on so important a Subject as the Necessity of erecting and constituting a new Form of Government and internal Police, to the Exclusion of all Foreign Jurisdictions, Dominion and Control whatever.—And whereas it appertains of Right solely to the People of this Colony to determine the said Doubts, Therefore" elections are appointed to be held to choose deputies representing New York's counties, to meet in the city on "the second Monday in July next" to determine the appropriate form of government. Because of the build up of British forces around New York City, the delegates selected actually met in White Plains; their efforts culminated in the adoption of the New York State Constitution, 20 April 1777. Rare: ESTC records just three copies (New-York Historical Society, Historical Society of Pennsylvania, and Library of Congress), and this appears to one of just two copies cited in the auction records since 1944.
